Does that not amount to cheating people who have voted a person from a party ? How can a speaker not find time to decide for more than 6 months ? This process of Speaker, Governor & President should be changed.
A division Bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court on Thursday once again asked the Telangana advocate general to find out how much time would be needed by the Speaker and Chairman of the State Legislature to dispose the pending disqualification petitions filed against some MLAs and MLCs.
When counsel for the petitioners made a mention before the Bench with a plea to take up hearing on a batch of petitions seeking directions to the authorities for disqualification of certain MLAs and MLCs on the ground of defection, the Bench asked the advocate general to get the information from the legislature authority and inform the same by the next date of hearing.
Responding to a query from the Bench, advocate general K. Ramakrishna Reddy said that the court could not have a judicial review on petitions that were pending before the legislature. The Bench made it clear that the Court would decide whether it would have a judicial review on the issue or not only after knowing the details sought by it.
Mr E. Dayakar Rao, Telangana TDP floor leader, had moved a plea seeking the court to issue direction to the Telangana Speaker to expedite hearing on disqualification of three TDP MLAs, Mr Talasani Srinivas Yadav, Mr Teegala Krishna Reddy and Mr Challa Dharma Reddy.
Meanwhile Congress MLA Sampath Kumar had sought the disqualification of legislators Mr Kale Yadaiah, Mr D.S. Redya Naik, Mr G. Vittal Reddy and Mr K. Kanakaiah for joining the TRS. Also, Congress whip in the Telangana Legislative Council M.S. Prabhakar Rao had urged the court to declare action of the council in not fixing a date for hearing of his application seeking for disqualification of MLCs Mr K.R. Amos, Mr V. Bhoopal Reddy, Mr N. Rajalingam, Mr T. Bhanu Prasad Rao and Mr S. Jagadiswar Reddy as illegal. Mr Ponguleti Srinivas Reddy, YSR Congress MLA, had sought disqualification of party MLA Mr B. Madanlal.
